TERMS AND CONDITIONS
- These terms and conditions apply to the information on the
front page of Estimate and/or Invoice and are between the CLIENT,
being the individual or entity whose name is set forth on the
front page hereof, and ARK Restoration And Design, Ltd.(hereinafter
referred as "ARK").
- CLIENT warrants and represents that Client is the owner or
authorized agent of the deposited item(s) or object(s) described
on the “Estimate” and/or “Invoice”.
- CLIENT agrees that the information set forth on the front page
of this documents is for identification purposes only and shall
not constitute an appraisal, authentication or otherwise by ARK.
- CLIENT assumes sole responsibility for the object(s) deposited
with ARK and CLIENT shall be solely responsible for arranging
for insurance coverage of said object(s).
- CLIENT understands and agrees that any object(s) deposited
by CLIENT with ARK is deposited at
- CLIENT'S own risk as to possible loss thereof or damage thereto
resulting from work performed upon it, or from fire, flood or
otherwise.
- CLIENT understands and agrees that any objects deposited by
CLIENT with ARK may experience climatic and environmental changes,
including but not limited to temperature changes, relative humidity
fluctuation, and/or biological infestation, witch may or may
not cause physical changes to the deposited object(s).
- CLIENT assumes sole responsibility for the object(s) while
in transit and for the object's delivery points environments
and/or final resting place environment.
- Payment is due on receipt of invoice unless other arrangements
have been agreed in advance in writing. Payment is required before
collection of the object or objects.CLIENT agrees to the payment
terms set forth on the Estimate and/or Invoice.. Any failure
to abide by said payment terms shall be a default. In the event
of default, CLIENT agrees to pay interest on any unpaid balance
due, computed at the rate of 1 1/2% per month from the date of
default. CLIENT further agrees to pay ARK its costs, including
reasonable attorneys fees, incurred in connection with collection
of CLIENTS unpaid balance.
- ARK shall not be liable for any delay in delivery of any part
of the service or product due to accident, strikes, fires, government
regulations or other conditions or causes beyond the control
of ARK, its sellers or suppliers.
- ARK is not responsible for work left for pickup more than (30)
days after the actual completion date. Work remaining with ARK
more than thirty (30) days from the actual completion date is
subject to storage fees. Work remaining more than ninety (90)
days beyond the actual completion date shall be deemed abandoned
property.
- CLIENT is responsible for delivering and collecting their objects
to and from our studios.
- ARK will retain the copyright in any report that we prepare
and any photographs we take of the object
